AGENTlink PORTAL - TERMS OF USE

1. INTRODUCTION

  • 1.1 The below terms (the “Terms”) together with the terms of use http://www.deacon.co.uk/agents apply to you when you use Deacon’s AGENTlink online portal available at http://www.deacon-agentlink.co.uk (“Portal”). The Portal is made available to you for the purpose of helping you manage your property portfolio held with Deacon, by allowing you to view and print your policy portfolio details and get updates on how your claim is progressing (“Purpose”).
  • 1.2 Deacon is a trading name of Arthur J. Gallagher Insurance Brokers Limited which is registered in Scotland under company number SC108909 and has its registered office at Spectrum Building, 7th Floor, 55 Blythswood Street, Glasgow, G2 7AT.
  • 1.3 For the purposes of these Terms “we”, “us”, “our” means Deacon and “you”, “your” refers to you as an authorised user whom the Authorised Organisation has authorised to use the Portal and/or the Authorised Organisation.

2. ACCESS TO AGENTLINK

  • 2.1 In order to use the Portal, you must be an employee or member of staff of an Authorised Organisation who has been authorised to use the Portal (“Authorised Representative”). An “Authorised Organisation” means an organisation who has written authority from us to use the Portal in accordance with the Terms.
  • 2.2 In consideration of the use of the Portal, you agree to be bound by these Terms. These Terms apply to each and every occasion on which the Portal is accessed.
  • 2.3 To the extent that you are an Authorised Representative, we grant you a non-exclusive, non-transferable and revocable licence to use the Portal for the Purpose.
  • 2.4 If you cease to be an employee of the Authorised Organisation you are prohibited from accessing the Portal.
  • 2.5 You are only permitted to access the Portal for the Purpose and any other use is not permitted.

3. INFORMATION ON PORTAL

  • 3.1 You acknowledge that any information and other materials posted on the Portal may not be complete, accurate or up-to date. In particular, please be aware that the information shown in the Portal is only a subset of the information held by Deacon. Data presented is not a complete view of all data. By way of example, the Portal does not include information relating to open claims that were logged on any of Deacon’s former systems, namely open claims with loss dates prior to 1 May 2013.

4. AVAILABILITY OF PORTAL

  • Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice. We will not be liable if for any reason our site is unavailable at any time or for any period

5. CHANGES TO OUR TERMS

  • 5.1 We may revise these Terms at any time by amending this page.
  • 5.2 Please check this page from time to time to take notice of any changes we made, as they are binding on you

6. JURISDICTION AND APPLICABLE LAW

  • 6.1 The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
  • 6.2 These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
